The present work, “Prisoners’ Rights: An Indian Constitutional Approach – A Legal Study,” emerges from a deep academic and social commitment to examine one of the most complex yet underexplored areas of Indian legal jurisprudence. Prisons, despite being institutions hidden from public sight, remain a visible indicator of a nation’s commitment to justice, dignity, and constitutional morality. In India, where the Constitution stands as the supreme guardian of human rights, the treatment of prisoners becomes a crucial measure of how far these ideals have been realized in practice.

For decades, the prison system in India has carried the legacy of colonial regimes that emphasized punishment and control rather than reform and rehabilitation. Although independence brought with it a transformative constitutional vision grounded in liberty, equality, and human dignity, the prison administration has struggled to fully align itself with these values. This study attempts to trace this journey—from the punitive colonial mindset to the contemporary human rights-based approach championed by courts, scholars, and international bodies.

This book examines prisoners’ rights not as isolated legal provisions but as living constitutional principles that shape the functioning of a democratic society. It explores the philosophical foundations of punishment, the evolution of prison jurisprudence, the impact of international human rights instruments, and the role of the Indian judiciary in expanding the contours of Article 21. The study highlights systemic issues such as overcrowding, custodial violence, prolonged undertrial detention, inequality within prisons, and the challenges faced by vulnerable groups such as women, juveniles, and mentally ill prisoners.

The purpose of this work is not merely academic. It seeks to contribute to ongoing discussions surrounding criminal justice reform, constitutional accountability, and human rights protection. By bringing together constitutional theory, judicial decisions, statutory frameworks, and international norms, this book strives to provide a comprehensive and accessible resource for students, researchers, legal professionals, policymakers, and human rights advocates.
