Access to Justice for Juveniles Under JJ Act 2015: Recent Judicial Trends in India, Monograph

The Juvenile Justice (Care and Protection of Children) Act, 2015 makes a significant mark in Indian legislative history after infamous Delhi Gang Rape Case. It represents a courageous attempt to reconcile the ever competing demands of justice and child welfare.  Nearly a decade after its enactment the Act still remains a subject of significant controversy and critique. The ambitious provisions of the Act aims to ensure that every child is treated with dignity and provided with opportunities for rehabilitation frequently hit with the harsh realities of implementation. Juveniles are vulnerable than the other social groups and their victimization have reached staggering proportions around the world because of their tender age and physical vulnerability. The debate over the effectiveness of laws particularly concerning access to justice for children continues to reflect in legal and social discourse.

Access to justice under the Juvenile Justice Act, involves more than just the availability of legal recourse. It includes the ability of children to understand and benefit from the justice system through a combination of legal analysis and judicial pronouncements.
